The diffusion of technology in the US has taken place in an environment of both regulation and free enterprise. Each has been subject to manipulation by doctors and medical administrators that has fostered unprecedented ethical dilemmas and legal challenges. Understanding these developments and historical precedents may allow a more rational diffusion policy for medical technology in the future.

Prior to August Weismann’s 1889 germ-plasm theory, social reformers believed that humans could inherit the effects of a salubrious environment and, by passing environmentally-induced modifications to their offspring, achieve continuous progress. Weismann’s theory disrupted this logic and caused many to fear that they had little control over human development. As numerous historians have observed, this contributed to the birth of the eugenics movement. However, through an examination of the work of social scientists Lester Frank Ward, Richard T. Ely, Amos Griswold (...) Warner, James Mark Baldwin, Simon Nelson Patten, Alfred Kroeber, Walter Robinson Smith, and Luther Lee Bernard, I demonstrate that Weismann’s ideas also prompted scholars to create of theories of human progress in which the social environment had a central role and biological heredity had a diminished one. Furthermore, in creating a new theory of social progress based on a concept called “social heredity,” the thinkers surveyed in this article separated biological and social thought and asserted the independence of the American social sciences. I argue that this represents an important moment in the maturation of the human sciences, and I suggest that the germ-plasm theory of heredity deserves a larger place in histories of the development of the American social scientific disciplines. Background: Many people participating in dementia research may lack capacity to give informed consent and the relationship between cognitive function and capacity remains unclear. Recent changes in the law reinforce the need for robust and reproducible methods of assessing capacity when recruiting people for research.Aims: To identify numbers of capacitous participants in a pragmatic randomised trial of dementia treatment; to assess characteristics associated with capacity; to describe a legally acceptable consent process for research.Methods: As part of a pragmatic randomised controlled (...) trial of Ginkgo biloba for mild-moderate dementia, we used a consenting algorithm that met the requirements of existing case law and the exigencies of the new Mental Capacity Act. We decided who had capacity to give informed consent for participation in the trial using this algorithm and sought predictors of capacity.Results: Most participants with mild-moderate dementia in this trial were unable to give informed consent according to the legal criteria. When adjusted for confounding, the Mini Mental State examination did not predict the presence of capacity.Conclusion: Cognitive testing alone is insufficient to assess the presence of capacity. Researchers and clinicians need to be aware of the challenging processes regarding capacity assessment. We outline a procedure which we believe meets the ethical and legal requirements. (shrink)

Over the last decade, the news media have reported on corporate scandals involving high-profile organizations such as Arthur Anderson, AOL Time Warner,Enron, Halliburton, Kmart, and Xerox. In 2001, the Conference Board of Canada noted that supplier relationships represent some of the most common ethical problems in the private sector, and estimated that 95% of corporations in the United States and 86% of corporations in Canada have implemented ethical codes of conduct and are espousing their commitment to building relationship with (...) ethical suppliers. While a significant amount of research on corporate ethics has been published (for examples see Akaah and Riordan 1989; Cullen et al. 2003; Román and Ruiz 2005; Schminke et al. 2005; and Weaver et al. 1999a, 1999b), what still remains unknown is how and when a supplier’s ethical code of conduct matters to the buyer making decisions regarding their choice of suppliers. Argument and imagination are often interdependent. The Aesthetics of Argument is concerned with how this relationship may bear on argument's concern with truth, not just persuasion, and with the enhancement of understanding such interdependence may bring. The rationality of argument, conceived as the advancement of reasons for or against a claim, is not simply a matter of deductive validity. Whether arguments are relevant, have force, or look foolish cannot always be assessed in these terms. The discourses of agricultural extension reveal how actors represent their scientific activities and goals. The “transfer of technology” discourse developed with the professional U.S. extension service, reproducing its expert/lay power relations. Agroecology is emerging as a systems approach to preventing agricultural pollution. Its theoreticians argue that agroecology cannot be transferred like technology but must be extended through networks of participatory social learning. In California, hundreds of actors and dozens of institutions have cocreated agroecological partnerships using this alternative extension model. Bruno Latour's “circulatory system of science” model provides a superior theoretical framework for interpreting the participation and discourses of diverse actors in this extension practice. In this volume, John Warner grapples with one of Jean-Jacques Rousseau’s chief preoccupations: the problem of self-interest implicit in all social relationships. Not only did Rousseau never solve this problem, Warner argues, but he also believed it was fundamentally unsolvable—that social relationships could never restore wholeness to a self-interested human being. This engaging study is founded on two basic but important questions: what do we want out of human relationships, and are we able to achieve what we are (...) after? Warner traces his answers through the contours of Rousseau’s thought on three distinct types of relationships—sexual love, friendship, and civil or political association—as well as alternate interpretations of Rousseau, such as that of the neo-Kantian Rawlsian school. The result is an insightful exploration of the way Rousseau inspires readers to imbue social relations with purpose and meaning, only to show the impossibility of reaching wholeness through such relationships. While Rousseau may raise our hopes only to dash them, Rousseau and the Problem of Human Relations demonstrates that his ambitious failure offers unexpected insight into the human condition and into the limits of Rousseau’s critical act. Without a second thought, he picked out “the most beautiful, the most expensive, the most garish, the freshest and the most bizarre of the playthings.” But his horrified mother insisted he choose another, less extravagant present, and the little Baudelaire had to resign himself and relinquish his toy.The word joujou (not jouet, the usual word for toy) is almost a pet name with a nursery ring like a “teddy” or a “dolly”; its repetition hints at baby talk and hence at playing, as when a child exchanges endearments and questions with a toy in imaginary conversations and elaborate scenarios. Thus until recently (...) assessments of the literary quality of a philosopher's writing have commonly been treated as extraneous to its value as philosophy, and philosophical probing of die thought of a poem as irrelevant to a literary critic's final assessment ofit. For some works, however, such compromises seem forced; Four Quartets is a case in point. But the questions are plainly philosophical ones, and one does not need the authority of Leavis to see that the poem raises them. From a philosophical point ofview, the interesting questions are the status of the manner in which it does so and the nature of the "criterion that is not logic" which is said to have an internal relation to that "intelligent selfexposure to the poetry" which Leavis in his critical practice seeks to exemplify. Unfortunately, this late commentary on Eliot's poetry is among the weakest in the Leavis corpus, precisely lacking "intelligent self-exposure to the poetry";2 but this should not lead us to dismiss its more general claims. In earlier and far stronger criticism Leavis had already argued that "Burnt Norton" does "by strictly poetical means the business ofan epistemological and metaphysical inquiry" ("Eliot's Later Poetry," p. 65). Further, die most distinguished recent criticism of Eliot's poetry is probably that of A. D. Moody,3 and he too finds himself driven to place his own "ultimate beliefs" in relation to it. In his "intimate, funny, conversational style" (Library Journal), Brad Warner stage dives into the Sam Harris, Karen Armstrong, Christopher Hitchens mosh pit of the God or no God debate - and body surfs up with a typically provocative perspective. Warner was initially interested in Zen because he wanted to find God, but Zen Buddhism is usually thought of as godless. Warner travels around the world looking for insight and what he finds, in chapters like "Sam Harris Believes (...) in God," "God Doesn't Have to Be Real to Exist," and "What God Wants," and through visits to places including Israel, Mexico, and Northern Ireland, is the belief that Buddhism "is a way to approach and understand God without dealing with religion." The fact that the book's title is Warner's mis-remembrance of a Zen monk's quote is emblematic of his profoundly engaging and idiosyncratic take on the ineffable power of the "ground of all being.". This study investigated the multidimensional structure of judgements of emotional appropriateness, the degree to which an observer judges a target's emotion to conform to observer-valued expectations for emotion in that context. Participants (N=169) were shown one of two brief video clips of an actor either showing anger or neutral expressions in an anger-evoking situation of either low, medium, or high severity. Participants rated the target's emotion on the Perception of Emotion Appropriateness Rating Scale (PEARS), which taps observers’ perceptions of a (...) target's emotional appropriateness for a specific situation. We found that appropriateness ratings are comprised of three factors, assessment of Type Present (type of emotion in expression); Type Absent (missing key emotions); and Intensity (intensity with which the emotion is felt or expressed). Results are discussed in terms of the usefulness of a multidimensional conceptualisation of emotional appropriateness. (shrink)

The connections between science and education, disciplines which are usually considered separately, were particulary strong in the U.S.A. in the early decades of the nineteenth century. Many American scientists at that time were employed as educators, and interested in matters of pedagogy. Like educators they were interested in popularizing their subject, and promoting it into a profession. The overlapping of science and education was especially evident in the area of apparatus. The philosophical apparatus that American scientists were acquiring at a (...) great rate might be considered scientific. In fact, it was often used for public demonstrations of natural philosophy, and seldom used for the advancement of science. In many instances this apparatus was indistinguishable from that developed for the educational reform known as object teaching. The proliferation of this apparatus was furthered by a growing apparatus industry operating within a growing consumer culture. (shrink)

Computer and video games have become nearly ubiquitous among individuals in industrialized nations, and they have received increasing attention from researchers across many areas of scientific study. However, relatively little attention has been given to Massively-Multiplayer Online Games . The unique social context of MMOGs raises ethical questions about how communication occurs and how conflict is managed in the game world. In order to explore these questions, we compare the social context in Blizzard’s World of Warcraft and Disney’s Toontown, focusing (...) on griefing opportunities in each game. Humanistic management requires an expansion of economistic management to focus on flourishing for all at work through dignity and well-being. A dignity framework engaging the humanistic management perspective is used to explore mattering in organizational contexts. The framework acknowledges moral and spiritual levels of the human experience and incorporates transcendent and religious motivations, representing a more fully humanistic conception. Existential and interpersonal mattering are linked to various levels of the dignity experience at work, providing a practical way of understanding a (...) highly philosophical concept. Implications of mattering at work for humanistic management research, theory, and practice are discussed. Dignity and mattering provide important, human-centered, relationally-oriented concepts to help us understand how people live and experience their lives at work. (shrink)

Paul Grice is widely seen as a champion of the view that communication is an exercise in rational coordination through acts of speaker meaning. Since Grice, a central question has been “[h]ow much of this coordination derives from interlocutors’ specific knowledge of one another as people? How much exploits their knowledge of language itself?” Grice is seen as emphasizing the explanatory centrality of “interlocutors’ specific knowledge.” This picture overlooks Grice’s 1968 article “Utterer’s Meaning, Sentence Meaning, and Word Meaning,” in which (...) he explains communication through the utterance of sentences (and words and phrases) by appealing to an internalized syntax and semantics. This appears to put Grice squarely on the “knowledge of language itself” side of the explanation of communication. Is Grice right? Does an appeal to internalized syntax and semantics play a premier role in explaining communication through the utterance of sentences? If it does, what explanatory role is left for “interlocutors’ specific knowledge of one another”? I outline Grice’s position in “Utterer’s Meaning, Sentence Meaning, and Word Meaning” and compare it to Stephen Schiffer’s position in his 2015 article “Meaning and Formal Semantics in Generative Grammar,” which also assigns a central role in explaining communication to an internalized syntax and semantics. I then turn to what explanatory role remains for “interlocutors’ specific knowledge of one another.” I turn to Schiffer’s account of speaker meaning in his 1972 book Meaning, where he defines speaker meaning in terms of common knowledge (the recursive belief state of knowing, knowing we know, knowing we know we know, and so on). I show how to incorporate a common-knowledge-based account of speaker meaning into Schiffer’s 2015 appeal to an internalized syntax and semantics, and then I show how to use the resulting account to assign a substantive explanatory role “interlocutors’ specific knowledge of one another.”. Though Rousseau is recognized to have treated the problem of self-knowledge with great sensitivity, very little is known about a centrally important aspect of that treatment—his understanding of self-deception. I reconstruct this conception, emphasizing the importance of purposive but sub-intentional processes that work to enhance agents' self-esteem. I go on to argue that Rousseau's fundamental concern about the theater is its capacity to manipulate these processes in ways that make spectators both complicit in their own falsification and vulnerable to elite (...) domination. This argument, with its focus on the pervasive and often subconscious character of self-deception, not only problematizes an influential reading of Rousseau which emphasizes the epistemic availability of the “true” or “sincere” self, but also highlights the ongoing civic and moral threat posed by self-deceptive mental states. The late William Righter's fine and discriminating intelligence helps us to think this (...) through. This is no standard monograph on Henry James. While well-aware of the critical traditions of Jamesian scholarship (and the knowledgeable will be able to detect in his sensitive and often enlightening readings of the texts his engagement with those traditions), Righter sits lightly to this scholarship, ploughing his own furrow, using the later work of Henry James as a lens to question "void and value" in twentieth-century and, by extension, contemporary culture. American Memory in Henry James is elegantly, and indeed sometimes elusively, written, as befits a work on a man whose own stylistic stringency is, alas, so often not emulated by academic writings on his work. The flipside of this, of course, is that a reasonably educated background, including some acquaintance with James's texts, is assumed.Righter is concerned to explore the capacity of the novel form as represented by James to apprehend, through formal arrangement, the apparent incommensurability of the forces that drive history, culture, and human psychology on the one hand, and the frameworks of intelligibility and value within which we seek to live and by means of which we seek to exercise some control over them, on the other. James is apt for this purpose since he focuses on cultural dislocations, between America and Europe, and between past and present. America, for James, represents the overcoming of a late nineteenth-century tradition of civility (primarily, in his case, transcendentalist and Unitarian) by big business and the criteria of capitalism. This precipitates a split between "wasp" culture and an alienated, urban culture, both in danger of losing touch with their roots. Europe, of course, stands for continuity, in this specifically cultural sense, rather than rupture, and the project of importing European culture into America through museums (The Golden Bowl is very much in point here) is one of the ambiguities to which the text recurs.The first part, "America Deconstructed," sets the stage, using James's The [End Page 447] American Scene to analyze his notions of historical change and progression, and their implications for a sense of stable American identity. How is a society so committed to change and progress to honor its past creatively? Part two, "The Note of Europe," engages with The Ambassadors, seeing the victory of Wollett as an indication of the insubstantiality of a certain type of expatriate community, of Americans seeking to take on European culture. The main weight of the text is taken by the engagement with The Golden Bowl, to which the next two parts are dedicated. "Amerigo in American Nowhere" explores the way in which the central characters operate in a sort of void, with social context stripped away to reveal the dynamics of their failed equilibrium. In this, "America" and "England" have become virtually typological symbols. In the light of this reading of the text, Part four, "A Dark Fable of Love and Power," explores the implications for our shaping intelligence, especially ethical intelligence. In suggestive dialogue with Putnam and Nussbaum, Righter points to the difficulty of seeing the relevance of anything like the Categorical Imperative to The Golden Bowl. Rather, in this novel "the language of morality has been examined, picked up, turned over, taken to pieces. But this very process has in the end indicated its unsuitability as an ultimate explanatory scheme." He argues that James poses the possibility that the novel "adds up to a total story which is intelligible beyond the possibilities of a conceptual sorting out" (pp. 154-55).But this raises the question of what the criteria for intelligibility could be in such a case, if beyond the conceptual lies the imaginative. Capone and Bucca offer a socio-pragmatic analysis of President Trump’s utterance, ‘I hope you will let Flynn go’ to show that Trump illicitly tried to persuade Comey to drop the investigation of Flynn. I do not dispute that claim. Instead, I offer an overview of their argument—with one potential point of disagreement. Capone and Bucca assume, As pragmatic investigators typically do, that speakers have determinate intentions and reason in complex ways about how to realize those intentions. I suggest that speakers (...) may not have determinate intentions and may not engage in the complex types of reasoning pragmatics typically attributes to them. I do not suggest that this point undercuts Capone and Bucca’s claims; rather, it suggests that their emphasis on a normative component in pragmatic analysis is correct, and suggests that a focus on the normative component supports their claims. When is an indirect report of what a speaker meant correct? The question arises in the law. The Contract Law case of Spaulding v. Morse is a good example. Following their 1932 divorce, George Morse and Ruth Morse entered into a trust agreement in 1937 for the support of their minor son Richard. In that agreement, George promised to “pay to [Spaulding as] trustee in trust for his said minor son Richard the sum of twelve hundred dollars per year, payable (...) in equal monthly installments on the first day of each month until the entrance of Richard D. Morse into some college, university or higher institution of learning beyond the completion of the high school grades, and thereupon, instead of said payments, amounting to twelve hundred dollars yearly, he shall and will then pay to the trustee payments in the sum of twenty-two hundred dollars per year for a period of said higher education but not more than four years.” Richard graduated from high school on February 5, 1946 and, in the post-WWII continuation of the draft, was inducted into the army the following day. The question in the case is whether George, by the words of the trust agreement, meant that he would pay $1,200 per year for Richard’s support while he was in the army. Is that a correct indirect report of what George meant?The explanation I offer assumes Gricean analysis of speaker meaning, and it emphasizes the role of speaker meaning typically plays in solving coordination problems. A coordination problem is a situation “in which each person wants to participate in a group action but only if others also participate.” A classic example is a political protest: “each person might want to take part in an antigovernment protest but only if there are enough total protesters to make arrests and police repression unlikely.” Coordination problems arise in more mundane settings as well – in Spaulding v. Morse, for example. Ruth and George want to mutually agree on Richard’s support: Ruth wants to commit to an arrangement only if George does, and vice versa for George. In 1937, George and Ruth solved the problem through speaker meaning. By signing the trust agreement, George, with Ruth as his audience, meant that he obligated himself to a particular support agreement. When Ruth signed, she, with George as her audience, meant that she accepted the agreement. In general, parties often solve coordination problems through speaker meaning. If, for example, enough people can communicate their commitment to participate in the protest to enough people, the protest will take place.The account assigns a central role to the fact that speaker meaning facilitates coordination by creating relevant common knowledge. Common knowledge is “the recursive belief state in which A knows X, B knows X, A knows that B knows X, B knows that A knows X, ad infinitum.” Common knowledge facilitates coordination: “Actors coordinate when they have evidence for common knowledge, and refrain from coordinating when they do not.”. This article draws on feminism and post-structuralism to theorize a narrative framework for developing and critiquing therapeutic practices with women who have experienced child sexual abuse. I argue that both objectivism and relativism provide poor guides for conducting therapy and that it is only through situating our knowledges precisely that more liberatory therapy practices may be developed. This approach, termed ‘visible therapy’, is used to directly and explicitly challenge normative constructions of women, child sexual abuse and therapy. I argue that (...) it is necessary to explicate the embedded assumptions produced through practices of abuse, and which serve to construct children's experiences of that abuse, in order to ward against their reproduction within therapy relationships. I demonstrate that it is through situating and explicating the operations of power that the authenticity of experience and identity may be questioned and women's ongoing positioning as guilty victims may be challenged. Thus, I am concerned not with who women ‘really are’ but with how they come to know and be known through practices of both abuse and therapy. This, then, is about making the tactics of abuse and therapy visible. Problems are not located within individuals, but rather within the narratives which situate both past and current relationships but which, through reiteration, obscure their own social production. I conclude that it is only when categorical identity is no longer assumed that progressive therapy practices with women who have been sexually abused can be developed and maintained. (shrink)
